With an eye in part toward making selections who may have to seek approval from a Republican-controlled Senate, Biden has prioritized choosing qualified professionals while eschewing flashy names. Even the most recognizable pick — John Kerry — lacks the showmanship that has defined the Trump era.
In sharp contrast to President Donald Trump, who openly distrusted the very government he led, Biden has showcased a faith in bureaucracy that was born out of his nearly five decades in Washington. He's made hires with the deliberate aim of projecting a sense of dutiful and, even boring, competency.
Surrounding himself with longtime aides and veterans of the Obama administration, many of whom have already worked together for years, Biden has rolled out a team of careerists with bursting resumes and little need of a learning curve.
“Collectively, this team has secured some of the most defining national security and diplomatic achievements in recent memory — made possible through decades of experience working with our partners,” Biden said Tuesday as he unveiled his national security team.
“Experience” is indeed the coin of the realm on Biden’s burgeoning team. His pick for secretary of state, Antony Blinken, worked for Biden in the Senate for years, and held the posts of deputy secretary of state and deputy national security adviser. His choice for national security adviser, Jake Sullivan, was the deputy to that post under President Barack Obama. His nominee for treasury secretary, Janet Yellen, was chair of the Federal Reserve and chair of the White House Council of Economic Advisers. His incoming White House chief of staff, Ron Klain, was chief of staff to two vice presidents — Al Gore and Biden himself — and was the Obama administration’s Ebola czar.
And Kerry, Biden’s choice to fill the newly created post of presidential climate envoy, was a longtime U.S. senator and his party’s 2004 presidential nominee before serving as secretary of state. “The team is bringing competency and experience, which are two separate things but deeply interwoven,” said retired Navy Adm. James Stavridis, former NATO supreme allied commander Europe, who has worked with much of Biden’s new team. “There are deputies stepping up into full roles, seasoned hands returning to the job. They tend to be calm and centered and they won’t all fight over the ball.”
“They know their counterparts overseas and they know whom to pick up the phone and call,” said Stavridis. “It’s a completely different approach than what we saw with the Trump team — and I hesitate to call it a team because they didn’t work all that well together.”
Four years ago, contenders for Cabinet posts were marched through the gilded lobby of Trump Tower, the president-elect’s Manhattan skyscraper, in full view of reporters and TV cameras. The candidates publicly jockeyed for posts, Trump aides took turn knifing each other in the media, and the incoming president even took one secretary of state contender, Mitt Romney, out to dinner for a public and ultimately unsuccessful audition.
Conversely, Biden’s transition hiring process has been carried out behind closed doors or, out of concern for the surging pandemic, on Zoom and over the phone. Leaks to reporters have been few. And the public only got its first glimpse of Biden’s choices when they took their spots, spaced apart and wearing masks, on a Delaware stage.
Another change was the distinct lack of tributes from the staffers about their boss, a marked difference from the lengthy, glowing venerations of the president that came to define any Trump Cabinet meeting. Also different: No one who stood with Biden was a family member or an in-law.
“The contrast between Biden's selections and Trump’s selections are like night and day: Biden’s picks are capable, sensible and play well in the sandbox together,” said Steve Rattner, a former Obama economic adviser. “Biden prefers people he has known for decades. Trump picked Rex Tillerson because he thought he looked like a secretary of state.”
There are risks. Many progressive Democrats aren't looking for simply a return to the Obama years, which ended with many on the left frustrated at the slow pace of change. Republicans are also unimpressed with Biden's hires.
“Biden’s cabinet picks went to Ivy League schools, have strong resumes, attend all the right conferences & will be polite & orderly caretakers of America’s decline,” tweeted Florida Sen. Marco Rubio, who may seek the White House again in 2024.
Trump’s own hiring process was besieged with chaos of his own making. He jettisoned the man in charge of his transition — former Gov. Chris Christie, R-N.J. — and more than 30 binders that Christie had prepared in favor of a staffing plan based on his gut, family recommendations and, yes, by his own admission, choices who looked straight out of central casting.
The tumult didn’t end once he took office. While a few of his picks were establishment choices, like Marine Gen. Jim Mattis to run the Pentagon, most were plucked from the corporate world — like Tillerson at the State Department and Steven Mnuchin at the Treasury Department. His senior adviser, Steve Bannon, said he wanted to oversee “the destruction of the administrative state.”
Trump had more senior staff and Cabinet turnover than any modern predecessor — his first national security adviser, Michael Flynn, didn’t last a month — and he declared an informal war on the federal bureaucracy once the investigation began into whether his campaign had any ties to Russia.
Deeply suspicious of what he deemed the "deep state,” Trump allowed scores of vacancies to remain unfilled across federal agencies, fired officials he deemed insufficiently loyal, encouraged in-fighting on his staff and, with relentless public attacks, attempted to undermine Americans’ faith in the institutions of their own government.

Attorney Bobbi Sternheim told a Manhattan judge that Maxwell faces more restrictive conditions than inmates convicted of terrorism or murder. Maxwell has no history of mental health issues or suicidal ideation and no criminal history, either, she said.
She asked a judge to intervene on her client’s behalf to improve her conditions at the Metropolitan Detention Center in Brooklyn. In her request, Sternheim made no direct reference to Epstein taking his life in August 2019 in his cell at another federal lockup, in Manhattan.
U.S. District Judge Alison J. Nathan instructed defense lawyers and prosecutors to confer over the next week over Sternheim's request that the Brooklyn facility's warden directly address the concerns.
A spokesperson for prosecutors declined comment. A message for comment was sent to the Federal Bureau of Prisons spokespeople. Maxwell, 58, has pleaded not guilty to charges that she procured three girls for Epstein to abuse in the mid-1990s. She has been held without bail while she prepares for a July trial.
On Monday, prosecutors notified the judge that Maxwell was put in quarantine last week for 14 days after someone who works in her area of the jail tested positive for the coronavirus. She may not meet with her defense team during that period.
In their letter, prosecutors said the 13 hours a day Maxwell gets to review trial materials on a laptop computer is more time than any other prisoner is allotted. The reference bothered Sternheim, who said Maxwell faces burdens unmatched by other inmates and has been mistreated. She noted that the latest production of evidence by prosecutors was over one million documents and Maxwell lacked enough time to study the material.
She said Maxwell was initially quarantined without soap or a toothbrush and that medical and psychology staff stopped checking on her, failing to tell her the results of her COVID-19 tests or what to do if she becomes symptomatic. Prosecutors said Monday that her test result for the coronavirus was negative, and she will be tested again at the conclusion of her quarantine.
The lawyer said Maxwell is kept in what is, in effect, solitary confinement and she is excessively and invasively searched and monitored 24 hours a day, including camera surveillance in her cell and a camera following her movement whenever she is permitted to leave her cell.
“And despite non-stop in-cell camera surveillance, Ms. Maxwell’s sleep is disrupted every 15 minutes when she is awakened by a flashlight to ascertain whether she is breathing,” she wrote.

About 40 people were injured, including five who were shot, according to emergency services. It was unclear who fired the shots and whether they were live rounds or rubber bullets. Some of the injuries occurred during a brawl between the pro-democracy protesters and stone-throwing royalists who oppose constitutional change.
Police used tear gas and water cannons laced with irritating chemicals against the student-led demonstrators, who tried to push their way past barbed-wire barriers to enter the grounds of the legislature on the outskirts of Bangkok.
The chaotic street confrontations began in midafternoon and ended about six hours later, when protest leaders called a halt and sent followers home. It was the worst violence during months of actions by the protesters, though police had previously employed water cannons at least twice. The protest movement has been staging increasingly determined mass rallies of thousands of people around the country.
Lawmakers are scheduled to vote on seven proposed constitutional amendments during a two-day joint session of the elected House and appointed Senate. Constitutional changes require a joint vote of both bodies. Any motions that are passed will have to go through second and third votes at least a month after this week’s balloting.
Lawmakers adjourned a previous session without voting on proposed amendments, leading the protesters to accuse the government of bad faith. The parliamentary session is an effort by the government of Prime Minister Prayuth Chan-ocha to take the initiative away from the pro-democracy movement, which in addition to seeking constitutional changes and reforms to the monarchy wants Prayuth and his government to step down.
The protesters say that Prayuth, who as army chief in 2014 led a coup that ousted an elected government, returned to power unfairly in last year’s election because laws had been changed to favor a pro-military party. The protesters also say the constitution, written and enacted under military rule, is undemocratic.
Reform of the monarchy is a key demand of the protest movement, which believes the royal institution is too powerful and lacks accountability. The unprecedented demand has touched a raw nerve in Thailand, where reverence for the royal institution is inculcated from birth and protected by a law that makes defaming the monarch and his immediate family punishable by up to 15 years in prison.
Tuesday's violence grew as about 1,000 protesters were pushed back by police water cannons as they tried to breach barriers set up on several streets to keep them from entering the Parliament compound.
Police also fired fired tear gas canisters, some of which were tossed back by demonstrators, many of whom wore helmets and other protective gear. The Erawan emergency medical services group said 41 people were injured, including five who were shot in the leg, stomach or wrist. No further details were available. Police later denied firing any guns and said they had complied with laws and international standards.
A protest leader, Parit “Penguin” Chiwarak, announced at about 8 p.m. that the demonstrators had captured enough ground to declare they had achieved their goal of surrounding Parliament. Some lawmakers had already left the scene by boat from a pier behind Parliament.
Parit announced another rally on Wednesday afternoon at the busy Rajprasong intersection in the heart of Bangkok’s main shopping district. Parliament is not expected to agree on specific constitutional changes at this point. The protesters back a proposal that would roll back aspects of the current 2017 constitution — enacted during military rule — that granted extra powers to unelected branches of government, such as the Senate.
Instead, Parliament is likely to establish a drafting committee to write a new charter. This would allow the government to say it is willing to meet the protesters’ demands at least halfway, while buying time with a process that could extend over many months.
Any change to sections of the constitution concerning the monarchy is fiercely opposed by the government and its supporters, who consider the monarchy untouchable. Thailand has had 20 constitutions since abolishing the absolute monarchy in 1932 in favor of a constitutional monarchy.

Police on Tuesday issued summonses for 12 protest leaders to answer charges of lese majeste, defaming or insulting key members of the royal family. The offense is punishable by up to 15 years imprisonment.
The law is controversial, because anyone — not just royals or authorities — can lodge a complaint, so it had in the past been used as a weapon in political vendettas. But it has not been employed for the past three years, after King Maha Vajiralongkorn informed the government that he did not wish to see its use. The king has not publicly commented on the law since then.
According to the legal aid group Thai Lawyers for Human Rights, the 12 suspects include top protest leaders known for their public criticism of the monarchy. Many in the student-led protest movement believe the monarchy holds too much power for a constitutional monarchy. But their challenge is fiercely opposed by royalists, who consider the royal institution an untouchable bedrock of national identity.
One of the 12 protest leaders, Parit “Penguin” Chiwarak, posted his response to the summons on Twitter on Tuesday, saying: “I am not afraid anymore. The ceiling (of our demands) is destroyed. Nobody can stop us now.”
The protest movement late Tuesday night announced a change of venue for their latest rally, which was to put a focus on the monarchy. It had earlier announced that it would be held outside the offices of the Crown Property Bureau, which manages the vast fortune controlled by the king.
The target was switched to the head office of the Siam Commercial Bank, a publicly-held company in which the king is the biggest shareholder. The bank’s headquarters are in a different area of Bangkok, far from the district hosting the Crown Property Bureau and other royal and government offices.
The protest movement announced the change of venue was to avoid a confrontation with police and royalist counter demonstrators, which they said they feared could trigger a declaration of martial law or a coup by the military.
Barbed wire had already been installed around the Crown Property Bureau offices and the government had declared an exclusion zone of 150 meters (500 feet) around the property into which it would be illegal for protesters to enter. The bank, as a commercial enterprise rather than a royal office, apparently would not fall into the legal category of areas where an exclusion zone could be declared.
A protest rally on Nov. 17 turned chaotic, as police employed water cannons and tear gas to block the protesters from entering the Parliament grounds. At least 55 people were hurt, including six reported to have had gunshot wounds, incurred in circumstances that remain unclear. Police denied firing live rounds or rubber bullets.
The next day, several thousand demonstrators gathered outside the national headquarters of the police in central Bangkok to protest the use of force. The rally at police headquarters was nonviolent but fueled royalist outrage at the protest movement, as demonstrators defaced the Royal Thai Police sign and scrawled graffiti and chanted slogans that could be considered derogatory to the king.
Prayuth reacted by declaring that the protesters had gone too far and could now expect to be prosecuted for their illegal actions. While protest leaders have faced dozens of charges over the past few months, they have generally been freed on bail, and none have yet come to trial.
A statement issued Wednesday by Free Youth, a driving force in a coalition of protest groups, called Thailand a failed state whose people “are ruled by capitalists, military, and feudalists.” “And under this state, the ruling class oppress the people who are the true founders and heirs of this country,” said the statement, the most strident issued so far in the name of the group.
Many of their rallies have had a light-hearted element, with clever slogans and songs. But the statement declared that “This is not a frivolous fad, it is a fearless fight to light up the future in our generation.”

Thai officials did not go so far as to call it a prisoner swap or say what involvement Australia might have had in the arrangement. Iranian state TV said Tehran released British-Australian Kylie Moore-Gilbert in exchange for three Iranians held abroad.
Chatchom Akapin, Thailand's deputy attorney general, told The Associated Press that Thai authorities had approved the transfer of the prisoners under an agreement with Iran. “These types of transfers aren’t unusual," he said. “We transfer prisoners to other countries and at the same time receive Thais back under this type of agreement all the time.”
In Australia, Prime Minister Scott Morrison said he was “thrilled and relieved” that Moore-Gilbert had been released but added it would take time for her to process her “horrible” ordeal. Flight data obtained by the AP showed the plane filmed on the tarmac at the Tehran airport had this week twice flown from Bangkok to Tehran, and then on to Doha, Qatar.
The plane's tail number links it to an Australian private air carrier called Skytraders, which describes itself as a “principal provider of air services to government.” An employee at the company declined to comment when reached by the AP.
The bomb plot of the three Iranians was exposed in 2012 when an accidental explosion blew apart the Bangkok villa where they were staying. Israeli and Thai officials have said the plot was aimed at Israeli diplomats in Bangkok — though Iran denied the allegations and the men were never charged with terrorism.
Two of the men, Saeid Moradi and Mohammad Kharzei, were convicted in Thailand in 2013. Moradi was sentenced to life for attempting to murder a police officer, while Kharzei was sentenced to 15 years for possessing explosives.
Moradi, a factory technician from Tehran and a former soldier, lost parts of both legs as he tried to flee the villa on a crowded Bangkok street. He was carrying explosives from the house and dropped them in the street as police tried to stop him.
The third suspect, Masoud Sedaghatzadeh, was detained in Malaysia. In 2017, a federal court there ordered his extradition to Thailand. Israeli officials on Thursday had no immediate comment on the release of the Iranians.
Iran's report of the prisoner swap was scant on detail, saying only that the Iranians had been imprisoned for trying to bypass sanctions on Iran. Morrison said he had spoken with Moore-Gilbert on Thursday.
“The tone of her voice was very uplifting, particularly given what she has been through,” Morrison told Australia’s Network Nine. Asked about the swap, Morrison said he “wouldn’t go into those details, confirm them one way or the other” but said he could assure Australians there had been nothing done to prejudice their safety and no prisoners were released in Australia.
In a statement, Moore-Gilbert thanked Australia’s government and diplomats for securing her release, as well as supporters who campaigned for her freedom. Despite her ordeal, Moore-Gilbert said she had “nothing but respect, love and admiration for the great nation of Iran and its warm-hearted, generous and brave people.”
Moore-Gilbert was a Melbourne University lecturer on Middle Eastern studies when she was picked up at the Tehran airport as she tried to leave the country after attending an academic conference in 2018. She was sent to Tehran’s notorious Evin prison, convicted of spying and sentenced to 10 years. She had vehemently denied the charges and maintained her innocence.
She was one of several Westerners held in Iran on widely criticized espionage charges that activists and U.N. investigators believe is a systematic effort to leverage their imprisonment for money or influence in negotiations with the West. Tehran denies it. Moore-Gilbert wrote in letters to Morrison that she had been imprisoned “to extort” the Australian government.
Her detention had strained relations between Iran and the West at a time of already escalating tensions, which reached a fever pitch earlier this year following the American killing of a top Iranian general in Baghdad and retaliatory Iranian strikes on a U.S. military base.
Iran state TV aired footage showing her clad in a gray hijab sitting at what appeared to be a greeting room at Mehrabad International Airport in Tehran. She was later seen getting on an Australian-flagged white aircraft, shown to her seat by a man in a suit.
The TV report did not elaborate on the Iranians it described as “economic activists” freed in exchange for Moore-Gilbert. They wore Iranian flags draped over their shoulders, black baseball caps pulled down over their eyes and surgical masks, outfits apparently designed to conceal their identities. Iran’s deputy foreign minister, Abbas Araghchi, welcomed the three Iranians at the airport.
International pressure has been building on Iran to release Moore-Gilbert. She has gone on repeated hunger strikes and her health has deteriorated during long stretches in solitary confinement. Over the summer, she was transferred to the remote Qarchak Prison, east of Tehran, as fears escalated over the spread of the coronavirus in the country’s notoriously crowded prisons.
Moore-Gilbert had appealed to the Australian government to work harder for her release. In her letters to the prime minister, she wrote that she had been subjected to “grievous violations” of her rights, including psychological torture.

Crowds of royal devotees waited for hours Sunday outside the white walls of the storybook palace compound to greet them, carrying portraits of King Maha Vajiralongkorn and Queen Suthida and waving national flags.
The monarch waved to the crowd and smiled, surrounded by aides who crouched beside him as he walked. He paused briefly to make a rare comment when asked what he would say to the protesters who have been demanding reforms.
“We love them all the same,” the Thai king told the UK’s Channel 4. Asked if there was room to compromise with protesters, the king said, “Thailand is the land of compromise,” and quickly turned to walk away.
The unprecedented challenge to decades of tradition has led royalists — mainly older Thais — to stage their own counter-rallies and to denounce the protesters for raising the issue, increasing the risk of violent confrontations or intervention by the army, which declares defense of the monarchy to be one of its main duties.
Virtually all of the supporters in the crowd Sunday wore yellow shirts, signifying loyalty to the crown. “I came here today led by my heart,” said 44-year-old businesswoman and astrological consultant Pakawarin Damrongrotthawee. “Born as Thais, we must be grateful to the monarchy. If anyone wants to protest the government, they can do it. But they must not touch the monarchy.”
As the smiling royal couple emerged, members of the crowd shouted “Long live the King!” and kissed the monarch’s feet as the couple passed, several wiping them with a towel. Some onlookers reached out to touch his hand, and gave the couple yellow roses as they went by. Other members of the royal family followed in their wake.
It was the latest of several such events in Thai cities and came after another week in which student-led demonstrations sought change to the powerful royal institution. Supporters of the monarchy among the public at large have failed on their own to work up the same excitement and crowds as the pro-democracy demonstrators.
But the photogenic opportunities of a royal walkabout, with crowds drawn by the rare chance to get up close and personal with the king, are a way of showing that many Thais appear satisfied with the monarchy as it is. Members of the media were also allowed unusually close access.
“This is my first time to come to greet the king,” said 55-year-old Siraseth Limpisuree. “I would like to encourage him, as a group of Thai people has a wrong attitude toward the monarchy. I want them to understand that the monarchy is part of Thai society and Thailand can never survive without the monarchy. We should not get the monarchy involved in political chaos. The government can be changed, but the monarchy should not be reformed as they (the protesters) demand.”
The student-led protesters charge that the palace exercises undue power and influence for a constitutional monarchy, and seek to have it made more accountable under law. They deny they want to see the royal institution abolished.
The demands to reform the monarchy have shattered a taboo in a way that would have seemed unthinkable just a few months ago. The royal institution has traditionally been presented as the nation’s cornerstone and above criticism.
But the institution's foundations were shaken by the death in 2016 of Vajiralongkorn’s father, King Bhumibol, after seven decades on the throne, leaving it vulnerable to criticism, despite a strict law against defaming the monarchy that can bring prison terms of up to 15 years.
The protests began in earnest in July and originally demanded political changes — including new elections and a more democratic constitution — but parallel demands for reform of the monarchy have since taken center stage.
Thousands had marched to the German Embassy in Bangkok last Monday to appeal to Chancellor Angela Merkel’s government to investigate whether Thailand’s king has exercised political power during his extended stays in Bavaria.
On Thursday, protesters laid out a red carpet on a major city street and staged a satirical fashion show, parodying an event being held at the same time by Princess Sirivannavari Nariratana, a daughter of the king who is a fashion designer, at a luxury hotel nearby.

NEW YORK (AP) — A lawyer for Ghislaine Maxwell, a British socialite charged with finding girls in the 1990s for financier Jeffrey Epstein to sexually abuse, said Tuesday that her client is awakened every 15 minutes in jail while she sleeps to ensure she's breathing.

Attorney Bobbi Sternheim told a Manhattan judge that Maxwell faces more restrictive conditions than inmates convicted of terrorism or murder. Maxwell has no history of mental health issues or suicidal ideation and no criminal history, either, she said.
She asked a judge to intervene on her client’s behalf to improve her conditions at the Metropolitan Detention Center in Brooklyn. In her request, Sternheim made no direct reference to Epstein taking his life in August 2019 in his cell at another federal lockup, in Manhattan.
U.S. District Judge Alison J. Nathan instructed defense lawyers and prosecutors to confer over the next week over Sternheim's request that the Brooklyn facility's warden directly address the concerns.
A spokesperson for prosecutors declined comment. A message for comment was sent to the Federal Bureau of Prisons spokespeople. Maxwell, 58, has pleaded not guilty to charges that she procured three girls for Epstein to abuse in the mid-1990s. She has been held without bail while she prepares for a July trial.
On Monday, prosecutors notified the judge that Maxwell was put in quarantine last week for 14 days after someone who works in her area of the jail tested positive for the coronavirus. She may not meet with her defense team during that period.
In their letter, prosecutors said the 13 hours a day Maxwell gets to review trial materials on a laptop computer is more time than any other prisoner is allotted. The reference bothered Sternheim, who said Maxwell faces burdens unmatched by other inmates and has been mistreated. She noted that the latest production of evidence by prosecutors was over one million documents and Maxwell lacked enough time to study the material.
She said Maxwell was initially quarantined without soap or a toothbrush and that medical and psychology staff stopped checking on her, failing to tell her the results of her COVID-19 tests or what to do if she becomes symptomatic. Prosecutors said Monday that her test result for the coronavirus was negative, and she will be tested again at the conclusion of her quarantine.
The lawyer said Maxwell is kept in what is, in effect, solitary confinement and she is excessively and invasively searched and monitored 24 hours a day, including camera surveillance in her cell and a camera following her movement whenever she is permitted to leave her cell.
“And despite non-stop in-cell camera surveillance, Ms. Maxwell’s sleep is disrupted every 15 minutes when she is awakened by a flashlight to ascertain whether she is breathing,” she wrote.

Trump still refused to concede and vowed to continue to fight in court after General Services Administrator Emily Murphy gave the green light for Biden to coordinate with federal agencies ahead of his Jan. 20 inauguration. But Trump did tweet that he was directing his team to cooperate on the transition.
Monday’s fast-moving series of events seemed to let much of the air out of Trump’s frantic efforts to undermine the will of the people in what has amounted to a weekslong stress test for American democracy. But Trump’s attempts to foment a crisis of confidence in the political system and the fairness of U.S. elections haven’t ended and are likely to persist well beyond his lame-duck presidency.
Murphy, explaining her decision, cited "recent developments involving legal challenges and certifications of election results.” She acted after Michigan on Monday certified Biden’s victory in the battleground state, and a federal judge in Pennsylvania tossed a Trump campaign lawsuit on Saturday seeking to prevent certification in that state.
It also comes as an increasing number of Republicans were publicly acknowledging Biden’s victory, after weeks of tolerating Trump’s baseless claims of fraud. The president had grown increasingly frustrated with the flailing tactics of his legal team.
In recent days, senior Trump aides including chief of staff Mark Meadows and White House counsel Pat Cipollone had also encouraged him to allow the transition to begin, telling the president he didn’t need to concede but could no longer justify withholding support to the Biden transition.
Yohannes Abraham, executive director of the Biden transition, said the decision “is a needed step to begin tackling the challenges facing our nation, including getting the pandemic under control and our economy back on track.”
Murphy, a Trump appointee, has faced bipartisan criticism for failing to begin the transition process sooner, preventing Biden’s team from working with career agency officials on plans for his administration. The delay denied Biden access to highly classified national security briefings and hindered his team's ability to begin drawing up its own plans to respond to the raging coronavirus pandemic.
Murphy insisted she acted on her own. “Please know that I came to my decision independently, based on the law and available facts. I was never directly or indirectly pressured by any Executive Branch official—including those who work at the White House or GSA—with regard to the substance or timing of my decision,” she wrote in a letter to Biden.
Trump tweeted moments after Murphy's decision: “We will keep up the good fight and I believe we will prevail! Nevertheless, in the best interest of our Country, I am recommending that Emily and her team do what needs to be done with regard to initial protocols, and have told my team to do the same.”
Max Stier, president and CEO of the nonpartisan Partnership for Public Service, criticized the delay but said Biden’s team would be able to overcome it. “Unfortunately, every day lost to the delayed ascertainment was a missed opportunity for the outgoing administration to help President-elect Joe Biden prepare to meet our country’s greatest challenges," he said. "The good news is that the president-elect and his team are the most prepared and best equipped of any incoming administration in recent memory.”
Senate Democratic leader Chuck Schumer said the GSA action “is probably the closest thing to a concession that President Trump could issue.″ Noting that the nation “faces multiple crises that demand an orderly transition,″ Schumer urged Democrats and Republicans to “unite together for a smooth and peaceful transition that will benefit America.″
Murphy’s action came just 90 minutes after Michigan election officials certified Biden’s 154,000-vote victory in the state. The Board of State Canvassers, which has two Republicans and two Democrats, confirmed the results on a 3-0 vote with one GOP abstention. Trump and his allies had hoped to block the vote to allow time for an audit of ballots in Wayne County, where Trump has claimed without evidence that he was the victim of fraud. Biden crushed the president by more than 330,000 votes there.
Some Trump allies had expressed hope that state lawmakers could intervene in selecting Republican electors in states that do not certify. That long-shot bid is no longer possible in Michigan. “The people of Michigan have spoken. President-elect Biden won the State of Michigan by more than 154,000 votes, and he will be our next president on January 20th,” Michigan Gov. Gretchen Whitmer, a Democrat, said, adding it’s “time to put this election behind us.”
Trump was increasingly frustrated by his legal team, led by former New York City Mayor Rudy Giuliani, whose erratic public performances drew bipartisan mockery in recent weeks. Still, the legal challenges were expected to continue, as Trump seeks to keep his supporters on his side and keep his options open for opportuntities post-presidency.
In Pennsylvania on Saturday, a conservative Republican judge shot down the Trump campaign’s biggest legal effort in the state with a scathing ruling that questioned why he was supposed to disenfranchise 7 million voters with no evidence to back their claims and an inept legal argument at best.
But the lawyers still hope to block the state’s certification, quickly appealing to the 3rd U.S. Circuit Court of Appeals in Philadelphia, which ordered lawyers to file a brief Monday but did not agree to hear oral arguments.
The campaign, in its filings, asked for urgent consideration so it could challenge the state election results before they are certified next month. If not, they will seek to decertify them, the filings said.
Biden won Pennsylvania by more than 80,000 votes. Pennsylvania county election boards voted Monday, the state deadline, on whether to certify election results to the Department of State. The boards in two populous counties split along party lines, with majority Democrats in both places voting to certify. After all counties have sent certified results to Secretary of State Kathy Boockvar, she must then tabulate, compute and canvass votes for all races. The law requires her to perform that task quickly but does not set a specific deadline.
In Wisconsin, a recount in the state’s two largest liberal counties moved into its fourth day, with election officials in Milwaukee County complaining that Trump observers were slowing down the process with frequent challenges. Trump’s hope of reversing Biden’s victory there depends on disqualifying thousands of absentee ballots —- including the in-person absentee ballot cast by one of Trump’s own campaign attorneys in Dane County.
